Terms & conditions
Article 1 – Subscription
1 - By signing this contract, the undersigned declares that they are familiar with and agree (without reservation) to the general conditions. K-Motion reserves the right to make interim changes to the general conditions and lesson times.
2 - Membership is personal and non-transferable. Only the undersigned is entitled to attend classes on this basis.
Article 2 – Price and Price Changes
The price of the subscription is as agreed and indicated on the registration form.
2 - K-Motion reserves the right to make interim changes to the cost of tuition fees. In the event of a price increase, this will be announced a full calendar month prior to commencement.
Article 3 – Payment
1 - The undersigned shall be required to pay the monies due to K-Motion as agreed. This implies that the undersigned has sufficient funds in the bank account provided at the time of the direct debit.
2 - Subscription fees will be collected around the 1st of each month. In case the undersigned's balance is insufficient and/or if the direct debit is reversed, K-Motion is entitled to charge €7.50 in administration costs additional to the costs that are charged by Mollie.
3 - In the event of late payment, K-Motion will give the undersigned another two weeks' written reminder to pay the amount due. If the undersigned again fails to pay on time, this shall constitute default. In such a case, K-Motion is entitled to charge statutory interest and extrajudicial costs.
4 - Absence of the member from one or more lessons does not release the undersigned from the obligation to pay.
5 - A single cancellation of a lesson does not entitle the member to a partial or full refund of the lesson fee.
Article 4 – Lesson and Visual Material
1 - It is not allowed to use the lesson material of the teachers without permission for performance elsewhere.
2 - It is not permitted to share visual material relating to lessons at K-Motion on the internet without permission.
3 - An employee of K-Motion may film during lessons. These recordings will mainly be used for learning purposes. Footage may also be used for social media. In this case, the teacher will ask for permission beforehand.
Article 5 – Termination of Subscription
1 - The subscription can be cancelled on a monthly basis. If the undersigned wishes to terminate their membership, this must be notified to K-Motion in writing. In the absence of notice of termination, the subscription will be renewed tacitly per month.
2 - A notice period of one full calendar month applies. For example: if a cancellation is submitted at any time in March, the subscription will end on April 30, and no further payments will be due as of May 1.
3 - K-Motion is entitled to terminate the membership prematurely with immediate effect if the undersigned fails to comply with the provisions of article 3 or fails to do so on time. Incorrect behaviour and misuse of equipment or facilities may also result in immediate termination of membership. Demonstrable damage to items within the (dance) venue as a result will be recovered in full from the member concerned.
Article 6 – Own Risk
1 - The undersigned hereby declares that attendance at classes at K-Motion is at his or her sole risk and that the costs of any accident or injury shall be borne entirely by the undersigned. By agreeing to this condition, the undersigned waives all rights to bring an action against K-Motion for compensation for costs, damage and interest as a consequence of any accident or injury sustained as a result of practising sport or using the facilities, as well as for the destruction of clothing and objects.
Article 7 – Personal Data
1 - The personal details of our members are strictly confidential and are used exclusively for K-Motion administrative purposes. This information will never be used for commercial purposes or made available to third parties.
2 - Changes relating to personal details (including telephone number and bank details) must be notified to K-Motion in writing as soon as possible.
Article 8 - Liability Insurance
1 - K-Motion holds a liability insurance policy that covers damages or injuries for which K-Motion can be held legally responsible. This insurance does not affect the participant's own responsibility to exercise due care during classes and activities. Participants are advised to have their own personal health and/or accident insurance, as K-Motion's coverage is limited to cases of proven legal liability.
Article 9 - Severability
1 - If any provision of these Terms and Conditions is found to be invalid, unlawful, or unenforceable, the remaining provisions shall remain in full force and effect. The invalid provision will be replaced by a valid one that most closely reflects the original intent of the parties.
Article 10 - Language
1 - These Terms and Conditions are available in several languages. In the event of any inconsistency or dispute regarding interpretation, the English version shall prevail.
